Importance Level Guide

Critical

Legally required — directly affects member rights and project validity

High Importance

Essential for transparency and accountability

Standard

Important supporting documents

🔴 Critical Categories

Legally mandated — every member must have access to these documents

📜

Society Resolutions

Special General Body resolutions passed by members for redevelopment consent

Critical

Why this matters

A Special General Body Resolution with ≥75% member consent is the legal foundation of the entire redevelopment. Without this, nothing is valid. Every member has the right to see this document.

Legal basis: Maharashtra Co-operative Societies Act, 1960 – Section 79A

2
🏛️

RERA Documents

RERA registration certificate, quarterly progress reports, and disclosures

Critical

Why this matters

RERA registration is legally mandatory for all redevelopment projects. The quarterly reports filed with MahaRERA are public documents that show actual vs planned progress. Members can cross-check builder claims.

Legal basis: Real Estate (Regulation & Development) Act, 2016 – Section 4 & 11

3
⚖️

Legal Documents

Development agreement, MOU, Power of Attorney, and legal opinions

Critical

Why this matters

The Development Agreement defines every obligation of the builder — corpus, transit rent, carpet area, timelines. Members must read and understand this before consenting. Legal opinions protect society interests.

Legal basis: Maharashtra Ownership Flats Act, 1963 – Section 4

4
🏛️

Government Approvals

IOD, CC, NOC, MCGM/NMMC approvals, environmental clearances

Critical

Why this matters

Without valid government approvals, construction is illegal. IOD (Intimation of Disapproval), CC (Commencement Certificate), and OC (Occupation Certificate) protect members from occupying an unauthorised building.

Legal basis: Maharashtra Regional & Town Planning Act, 1966

🔑

Flat Allotment Letters

Individual allotment letters specifying new flat number, carpet area, and floor for each member

Critical

Why this matters

This is the document that defines what each member will receive in the new building — their floor, flat number, carpet area, and car parking. Disputes over allotment are the #1 source of conflict in redevelopment.

Legal basis: Development Agreement – Schedule of Allotment

🟠 High Importance Categories

Essential for transparency, financial accountability, and oversight

💰

Financial Statements

Corpus fund details, builder payment milestones, society accounts, audit reports

High Importance

Why this matters

The corpus fund is the financial safety net for the society after redevelopment. Members should track how much has been collected, where it is invested, and when builder payments are due. Financial transparency prevents fraud.

Legal basis: Maharashtra Co-operative Societies Act – Section 75

2
🏠

Transit Rent Documents

Transit rent agreements, monthly payment schedules, and rental receipts for displaced members

High Importance

Why this matters

Members vacating their homes depend entirely on transit rent during construction. Delays or shortfalls in transit rent payments are a common grievance. All payment schedules and disbursements must be transparent.

Legal basis: Development Agreement – Transit Accommodation Clause

3
🔍

PMC / Engineer Reports

Project Management Consultant reports, structural engineer certificates, site inspection notes

High Importance

Why this matters

An independent PMC acts as the society's watchdog on site. Their monthly progress reports are the only unbiased assessment of construction quality and timeline adherence. Essential for holding the builder accountable.

4
📋

Meeting Minutes

Recorded minutes of every General Body and Committee meeting

High Importance

Why this matters

Meeting minutes are the official record of every decision made during redevelopment. If a dispute arises, minutes are the primary evidence. All 32 members have the right to access minutes of every meeting.

5
📨

Builder Circulars

Official communications and circulars issued by the builder to the society

High Importance

Why this matters

Builder circulars contain official commitments, construction updates, change requests, and timeline revisions. Archiving every circular creates an accountability trail — the builder cannot deny what was communicated in writing.

📐

Architect Drawings

Approved floor plans, elevations, site plans, and structural drawings

Standard

Why this matters

Approved architectural drawings show members exactly what the new building will look like — floor layouts, common areas, parking, amenities. Comparing approved drawings vs actual construction reveals deviations.

2
📄

Tender Documents

Tender notices, comparative statements, contractor evaluations, and award letters

Standard

Why this matters

Transparency in the builder/contractor selection process prevents nepotism and ensures the society got fair value. Tender documents show how competing bids were evaluated.

3
🛡️

Insurance Documents

Building insurance, contractor's all-risk insurance, member displacement insurance policies

Standard

Why this matters

Insurance protects members if construction causes injury, damage, or if the project stalls. Members should know they are covered during the transition period.

4
✅

Completion Certificates

Occupation Certificate (OC), Building Completion Certificate (BCC), fire NOC

Standard

Why this matters

Members must NOT move into the new building without a valid OC. Occupying a building without OC is illegal and can affect property registration. This category will be populated in the final phase.

5
📢

General Notices

General announcements, maintenance notices, event communications

Standard

Why this matters

Day-to-day communications from the committee to all members — vacancy notices, inspection dates, transit rent revision notices, and general society updates.

6
📁

Other Documents

Miscellaneous documents not covered by other categories

Standard

Why this matters

A catch-all for any document relevant to the redevelopment that does not fit the above categories.
